1. Introduction

Welcome to Roseway Tours (“we”, “us”, “our”, or “Roseway Tours”). By accessing or using our website at https://rosewaytours.com (the “Site”), booking a tour or activity, or otherwise using our services, you agree to be bound by this Agreement. If you do not agree, please do not use the Site or our services.

2. Services

Roseway Tours provides tours and travel experiences (the “Services”) as described on the Site. All bookings are subject to availability and to the terms set out in this Agreement (including the Cancellation Policy in Section 8).

3. Use of the Site

• You agree to use the Site only for lawful purposes.

• You must provide true, accurate, current and complete information when using any forms on the Site.

• We reserve the right to suspend or terminate your access to the Site at any time for any reason.

4. Booking & Payment

• When you make a booking, you agree to pay the price specified for the tour or activity at the time of booking.

• We may accept payment by credit card, debit card, bank transfer or other methods as we display on the Site.

• Unless otherwise stated, payment is required at the time of booking or according to the payment terms displayed.

• After payment, you will receive a confirmation of your booking.

5. Changes to Services

• Roseway Tours reserves the right to change, modify or cancel any tour or activity (including time, meeting point, guide, itinerary) for reasons beyond our control (weather, safety, strikes, etc.).

• If we cancel a tour for such reasons, we will either offer you an alternative tour of equivalent value, or a refund of the amount paid.

• If you choose to cancel because of the change, you must notify us in writing. The Cancellation Policy (Section 8) applies.

6. Liability & Travel Risk

• When participating in tours you acknowledge there are inherent risks associated with travel and outdoor activities. You agree to assume those risks.

• To the fullest extent permitted by law, our liability for any loss or damage arising out of or in connection with your booking or participation in a tour is limited to the amount you paid for the tour.

• We are not liable for indirect, incidental, or consequential damages.

• You agree to comply with all instructions, rules and guidance given by our guides or staff.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, videos, tour descriptions — is the property of Roseway Tours or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce or use the content except as permitted by us.

8. Cancellation Policy

8.1 Your Cancellation

• If you wish to cancel your booking, you must notify us in writing by email to our contact address (Rosa@rosewaytours.com) or via another notified method.

• Unless otherwise specified in the tour description, full refund of the tour price (less any non-refundable fees) is available if you cancel at least 48 hours prior to the scheduled departure time.

• If you cancel less than the timeframe stated (e.g., within 48 hours), you may not receive a refund; we reserve the right to retain the full tour price.

• No-shows may forfeit the full amount.

8.2 Our Cancellation

• If we cancel the tour due to circumstances beyond our control (force majeure, weather, safety etc.), we will offer you a full refund of the amount paid or an alternative tour at no extra cost.

• If we cancel for other reasons (for example insufficient participants), you will be notified in advance and offered a full refund or alternative.

8.3 Modifications

• If you wish to change your booking (date, number of people etc.), please contact us as soon as possible. Changes may be subject to availability and additional cost.

• The same timeframe for cancellation and refund applies to modifications.

8.4 Refunds

• Refunds will be processed using the same payment method you originally used unless otherwise agreed.

• It may take a few business days for a refunded amount to appear in your account, depending on your bank or payment provider.

9. Privacy Policy

9.1 Information We Collect

We collect the following types of personal data when you use our services or the Site:

• Contact information: name, email address, phone number.

• Booking information: details of the tour/activity, date, number of participants, special requests.

• Payment information: credit/debit card number, billing address (via our payment processor). We do not store full payment card details on our servers.

• Usage information: IP address, browser type, device identifiers, pages you visit on the Site.

• Marketing and communications data: your preferences, whether you’ve agreed to receive our newsletter or promotional material.

9.2 Use of Your Information

We use your personal data for the following purposes:

• To process and manage your booking and payments.

• To send you booking confirmations, updates, changes, cancellation notices.

• To communicate with you regarding our services, answer your questions and provide support.

After that period, we securely delete or anonymise your data.

• Rectify inaccurate or incomplete data.

12. Governing Law & Jurisdiction

This Agreement is governed by the laws of Italy (or region where Roseway Tours is registered). Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent court in the location of our registration.

13. Changes to This Agreement

We may update this Agreement from time to time. When we do so, we will post the new version on the Site and update the “Last updated” date. By continuing to use the Site or our services after changes are posted, you accept the revised Agreement.

14. General Terms

• If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

• Our failure to enforce any right under this Agreement does not waive that right.

• This Agreement constitutes the entire agreement between you and Roseway Tours concerning its subject matter.
